Terms of Use of the TBLT CoP Website

Please read these Terms of Use carefully before accessing or using the TBLT CoP Website.
1. ACCEPTANCE OF TERMS
TBLT CoP is a not-for-profit community of practice for second language teaching professionals registered as Members. TBLT CoP provides its Members with the opportunity to access and share pedagogical resources, attend professional learning events, and discuss ideas about second language learning.
The following Terms of Use, as well as the University of Alberta’s Information Technology Use and Management Policy, govern and apply to your use of the TBLT CoP Website (the “Website”). Your access and use of this Website indicates that you have read and understood these documents and that you agree to their terms.
2. AGE RESTRICTION
You must be at least 18 (eighteen) years of age before you can use this Website. By using this Website, you warrant that you are at least 18 years of age and you may legally adhere to this terms of use. TBLT CoP assumes no responsibility for liabilities related to age misrepresentation.
3. ACCOUNT AND ACCOUNT USE
Membership in TBLT CoP requires an account identifying you as a user of the Website. Membership is subject to approval by the TBLT CoP administrators. You agree to provide true, current and accurate information as requested in the Membership Form, and to keep this information up to date.
You are solely responsible for the maintenance, confidentiality and security of your account and any passwords related to it. You are also responsible for all activities that occur under your account or password.
If you think there are any possible issues regarding the security of your account on the Website, inform us immediately so we may address it accordingly.
4. PROTECTION OF PRIVACY
Before you continue using the Website, we advise you to read our FOIP Notification Statement and the University of Alberta’s Privacy Policy regarding our user data collection. It will help you better understand our practices. By accessing and using this Website you acknowledge that you have read and understood these documents and that you agree to their terms.
5. INTELLECTUAL PROPERTY
5.1 Content
All intellectual property on this Website (except Member Generated Content, as defined below) is owned by TBLT CoP or has been licensed to TBLT CoP by a third party. This includes but is not limited to text, design, graphics, images, sounds, videos, music, applications, software, code and any other content on the Website. All content is protected under the copyright details indicated on the content if applicable, and as indicated in these Terms of Use.
All content that is not posted by the TBLT CoP leadership team, whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such content originated and represent the views of that person, and not of TBLT CoP.
The Website may include links to third party sites for the convenience of the TBLT CoP Members. However, the TBLT CoP leadership team does not endorse or recommend any specific sites and is not responsible for their content.
5.2 Member Generated Content
Member Generated Content is defined as materials, text, images, graphics, sounds, videos, music, website links, messages, opinions and any other content that you and/or other Members of TBLT CoP post or otherwise make available on or through the Website. You are entirely responsible for all content that you upload, post, email, transmit or otherwise make available via the Website.
The TBLT CoP leadership team may pre-screen content before it is published, and we have the right (but not the obligation), in our sole discretion, to pre-screen, refuse, move or remove any content that is available via the Website. Members may report any inappropriate content to the leadership team.
In relation to content generated by you, you agree to grant TBLT CoP and its Members a license to use it under the following Creative Commons license:

except in those cases where an alternative license has been indicated by you on the applicable material.
By making your content available on the Website, you represent and warrant that:
- You are the owner of the content or you have obtained the necessary permissions to make it available on the Website;
- Your content does not contain objectionable material;
- Your content does not contain or install any viruses, worms, malware, or other harmful or destructive content;
- Your content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing).
5.3 Use of content and Member generated content
TBLT CoP Members may use any materials posted on the website for nonprofit educational purposes in their regular teaching practice (i.e., free of charge in your class). All other uses, unless otherwise stated on the applicable material, fall under the following Creative Commons license:

Use of any content posted on the Website is at the sole risk of the user. TBLT CoP does not guarantee the accuracy, integrity or quality of any content, and under no circumstances is TBLT CoP liable in any way for any content or for any loss or damage of any kind in connection with the use of any content.
Nothing in these Terms of Use may be interpreted as granting any license of intellectual property rights to you.
6. ACCEPTABLE USE
You agree not to use the TBLT CoP Website for any unlawful purpose. This includes, but is not limited to, using the Website to
- harass, abuse or threaten others;
- publish or distribute any obscene or defamatory material, or any material that incites violence, hate or discrimination towards any person or group, or any material that is otherwise objectionable;
- publish or distribute material for commercial purposes;
- publish or distribute any content that you do not have the right to make available;
- access or attempt to access other Members’ accounts;
- violate the intellectual property rights of TBLT CoP and/or of its Members;
and for any other unacceptable uses listed in the University of Alberta’s Information Technology Use and Management Policy and its Appendix A.
You agree to indemnify, defend, and hold TBLT CoP and its subsidiaries, affiliates, officers, agents, suppliers, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or make available through the Website, your use of or conduct with respect to the Website, your connection to the Website, your violation of these Terms of Use, or your violation of any rights of another.
7. SERVICE INTERRUPTIONS AND MODIFICATIONS
On occasion, we may need to interrupt your access to the Website to perform maintenance or emergency services on a scheduled or unscheduled basis. TBLT CoP reserves the right at any time and without notice to modify the service or to discontinue, temporarily or permanently, the service.
8. TERMINATION OF ACCOUNT
On becoming aware of any violation of these Terms of Use, or those in the University of Alberta’s Information Technology Use and Management Policy and its Appendix A, we may, at any time, in our sole discretion and without prior notice, suspend, restrict or terminate your account and your use of the Website.
9. NO WARRANTIES
Your use of the Website is at your sole and exclusive risk, and any services or materials provided by us are on an “as is” and “as available” basis. TBLT CoP disclaims any and all express or implied warranties of any kind, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranties that the Website will meet your requirements or needs, or that the Website will be uninterrupted, error-free or secure. We also make no warranties regarding the accuracy and reliability of any information on or obtained through the Website. You are solely responsible for any damage that may occur to you, through your computer system, or as a result of loss of your data, and we are not liable for any such damage or loss.
10. LIMITATION ON LIABILITY
TBLT CoP is not liable for any damages that may occur to you as a result of your use of the Website, to the fullest extent permitted by law.
11. MODIFICATIONS TO THESE TERMS OF USE
TBLT CoP may change, add or remove any part of these Terms of Use, or any other terms associated with the use of the Website, at any time, by posting a notice of such changes on the Website. Any such modifications shall be effective as of the date of the notice. By continuing your use of the Website after the notice is posted, you indicate your acceptance of those changes.
